1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and AppliedYet ("we", "us", or "our") governing your access to and use of the AppliedYet website at appliedyet.com and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms are governed by Australian law and comply with the Australian Consumer Lawcontained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2. Description of Service

AppliedYet is a web-based application tracking platform designed to help students and professionals manage their job application process. The Service allows you to:

  • Track job applications and their status
  • Maintain a timeline of application-related events
  • Organize application details, notes, and follow-up dates
  • Access your application data across devices

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years of age to create an account and use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Account Creation

To use certain features of the Service, you must create an account by providing:

  • A valid email address
  • A secure password
  • Your name

Alternatively, you may sign up using Google OAuth authentication.

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.4 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for lawful purposes only, specifically to:

  • Track and manage your personal job applications
  • Store and organize application-related information
  • Access your data for legitimate job search purposes

4.2 Prohibited Conduct

You agree NOT to:

  • Violate any applicable Australian or international laws or regulations
  • Infringe upon the intellectual property rights of others
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest personal information of other users
  • Use the Service for spam, phishing, or other fraudulent activities
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Create multiple accounts to circumvent Service limitations
  • Share your account credentials with others

4.3 Enforcement

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including but not limited to suspending or terminating accounts, reporting to law enforcement, and pursuing legal action.

5. User Content and Data

5.1 Your Content

You retain all ownership rights to the content you submit to the Service ("User Content"), including job application details, notes, and related information.

5.2 License to Use Your Content

By submitting User Content to the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

This license terminates when you delete your content or account.

5.3 Responsibility for User Content

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate any applicable laws or third-party rights
  • Your User Content does not contain malicious code or harmful content

5.4 Data Backup

While we implement reasonable backup procedures, you are responsible for maintaining your own backups of your User Content. We are not responsible for any loss of User Content.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by AppliedYet and protected by Australian and international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the Service
  • Distribute, sell, or sublicense any part of the Service
  • Remove or alter any copyright, trademark, or proprietary notices

6.4 Trademarks

"AppliedYet" and related marks are trademarks of AppliedYet. You may not use these trademarks without our prior written permission.

7. Fees and Payment

7.1 Free Service

AppliedYet is currently offered free of charge. We reserve the right to introduce paid features or subscription plans in the future.

7.2 Future Pricing

If we introduce fees, we will provide at least 30 days' notice before charging for previously free features. You may cancel your account before fees take effect if you do not wish to pay.

7.3 Price Display

All prices (if applicable in the future) will be displayed in Australian Dollars (AUD) and include GST where applicable.

8. Termination

8.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your Settings page or by contacting support@appliedyet.com.

8.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • You breach these Terms
  • You engage in fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Service

8.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service immediately ceases
  • Your User Content may be deleted (we may retain copies as required by law)
  • Provisions that by their nature should survive termination will survive

9. Disclaimers and Warranties

9.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, we disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of information obtained through the Service

9.2 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

9.3 No Professional Advice

The Service is for informational and organizational purposes only and does not constitute professional career advice, legal advice, or any other professional services. You should seek independent professional advice for your specific circumstances.

10. Limitation of Liability

10.1 Liability Cap

To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to these Terms or the Service is limited to:

  • The amount you paid us in the 12 months prior to the event giving rise to liability, or
  • $100 AUD (whichever is greater)

10.2 Excluded Damages

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Damages arising from third-party actions

10.3 Australian Consumer Law Exception

Nothing in this section limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by Australian law

10.4 Consumer Guarantees

If you are a consumer under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms purports to modify or exclude the conditions, warranties, and undertakings, and other legal rights, under the Australian Consumer Law and other laws.

11. Indemnification

You agree to indemnify, defend, and hold harmless AppliedYet, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Third-Party Services and Links

The Service may contain links to third-party websites or integrate with third-party services (e.g., Google OAuth). We are not responsible for:

  • The content or practices of third-party websites or services
  • Any damages arising from your use of third-party services

Your use of third-party services is governed by their respective terms and privacy policies.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Notify you via email (if you have an account)
  • Display a prominent notice on the Service

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

14. Dispute Resolution

14.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at support@appliedyet.com and attempt to resolve the dispute informally before pursuing formal legal action.

14.2 Governing Law

These Terms are governed by the laws of Australia (and the state/territory where AppliedYet operates). You agree to submit to the non-exclusive jurisdiction of the Australian courts.

14.3 Consumer Rights

Nothing in these Terms affects your rights as a consumer under the Australian Consumer Law to bring proceedings in any competent court.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AppliedYet regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.

15.6 No Partnership

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and AppliedYet.
